Terms and conditions of sale

​

These Terms of Sale (“Terms”) govern the purchase of paintings, artworks, or related products (“Artwork”) from Lee Tiller via his website or via any social media or via any exhibition or via any other method of communication not listed but including telephony. By placing an order, you agree to these Terms.

1. Pricing & Payment

  • All prices are listed in Euro (€) (and include VAT if, and where applicable).

  • Payment must be made in full at the time of purchase unless otherwise agreed in writing.

  • A deposit for an artwork may be accepted subject to prior agreement.

  • Transfer of ownership will only occur on completion of sale.

  • All deposits are non-refundable.

  • We accept payment through credit card or debit card, PayPal and bank transfer.

 

2. Orders & Contract

  • When you place an order, you will receive an email acknowledging receipt. This does not constitute acceptance.

  • A contract is formed only when we confirm acceptance of your order.

  • We reserve the right to refuse an order in the event of pricing errors, stock unavailability, or other issues.

  • We reserve the right to cancel a sale if the buyer, through action or inaction, prevents or unreasonably delays completion of the transaction (for example, non-payment, refusal to provide required information, or refusal to accept delivery).

  • In such cases, we may retain any deposit or payment already made to cover any of our incurred costs.

 

3. Delivery

  • We ship within Ireland, the EU, and internationally unless stated otherwise.

  • Delivery costs and estimated delivery times are provided at time of sale.

  • All risk passes to you upon delivery.

  • Ownership of the Artwork transfers to you only when full payment has been received.

  • Please inspect your order upon receipt and notify us immediately of any damage.

  • International shipments may be subject to import duties, taxes, and/or customs fees once the package reaches the buyer’s country. These charges are the responsibility of the buyer and are not included in the purchase price or shipping cost.

  • We are not responsible for delays caused by customs processes.

 

4. Returns & Cancellations

  • As an EU consumer, you have the right to cancel your purchase within 14 days of delivery without giving a reason.

  • To exercise this right, you must notify us in writing within this period.

  • You must return the Artwork in its original condition and packaging at your own cost, unless the item is faulty or damaged.

  • Refunds will be processed within 14 days of receiving the returned item.

  • Custom or commissioned artworks are non-refundable unless defective.

 

5. Intellectual Property & Copyright

  • Purchase of an Artwork transfers ownership of the physical object to you.

  • Copyright and all reproduction rights remain with the artist.

  • The Artwork may not be reproduced, distributed, or commercially exploited without our prior written consent.

 

6. Liability

  • We are not liable for any indirect or consequential losses arising from your purchase.

  • Our total liability in respect of any claim shall not exceed the price paid for the Artwork in question.

 

7. Governing Law

  • These Terms are governed by the laws of Ireland and the EU consumer protection framework.

  • Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
